These Terms and Conditions ("Terms") govern your access to and use of the services provided by Anungo Kavele & Co. Advocates ("the Firm"). By engaging our services, you agree to comply with these Terms. Please read them carefully.
1. Scope of Services
The Firm provides legal services across various practice areas, including but not limited to litigation, corporate law, property law, family law, and commercial transactions. The scope of services provided will be outlined in an engagement letter or retainer agreement specific to your case.
2. Client-Advocate Relationship
No client-lawyer relationship is established until:

A formal written agreement or engagement letter is signed.

Fees are agreed upon and the initial retainer (if applicable) is paid.
Consultations, whether verbal or written, do not constitute legal advice or a client-lawyer relationship unless confirmed by a signed retainer agreement.
3. Legal Advice Disclaimer
The information provided on our website or during initial consultations is general and should not be construed as legal advice. Each legal issue is unique, and specific legal advice tailored to your situation should be sought after formal engagement with the Firm.
4. Client Obligations
As a client, you are expected to:

Act in good faith and cooperate with the Firm during the representation.

Settle fees and disbursements in a timely manner as per the retainer agreement.
Failure to meet these obligations may result in the termination of services.
5. Fees and Payments
Legal fees will be agreed upon before any legal work is carried out, as stipulated in the retainer agreement. The Firm's fees may be based on hourly rates, fixed fees, or contingency fees, depending on the nature of the matter.

Billing: Clients will receive invoices at regular intervals or at the conclusion of the legal matter, depending on the engagement terms.

All information shared with the Firm will be treated as confidential and will not be disclosed to third parties without the client’s consent, except where required by law.
7. Conflict of Interest
The Firm will not represent clients where there is a direct conflict of interest with existing clients. If a conflict arises during representation, we will notify you immediately and take appropriate steps, which may include withdrawal from the case or resolving the conflict in a manner consistent with legal ethics.
8. Intellectual Property
All content provided by the Firm, including legal documents, reports, opinions, and advice, remains the intellectual property of Anungo Kavele & Co. Advocates unless otherwise stated. Clients may use such material for personal legal matters but may not reproduce, distribute, or use it for commercial purposes without written consent.
9. Limitation of Liability
To the fullest extent permitted by law, the Firm shall not be liable for:

Any indirect, consequential, or incidental damages arising from the use of our services.

Loss or damage resulting from incorrect information provided by the client.

Any delays in service provision due to factors beyond our control, such as court delays or governmental actions.
The Firm’s total liability, if found liable for any loss or damage, will be limited to the fees paid by the client for the services rendered.
10. Termination of Services
You may terminate our services at any time by providing written notice. The Firm also reserves the right to terminate the representation for valid reasons, including:

Non-payment of fees.

Failure to cooperate with the Firm.

Conflicts of interest.

Where continued representation would breach the law or professional conduct standards.
Upon termination, the client is liable for all legal fees and expenses incurred up to the date of termination.
11. Governing Law and Jurisdiction
These Terms and any legal engagement with the Firm shall be governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or the provision of legal services shall be subject to the exclusive jurisdiction of the courts of Kenya.
12. Dispute Resolution
In the event of a dispute or disagreement, parties will first seek to resolve the matter amicably through negotiation. If the dispute cannot be resolved within [insert time period], parties may agree to mediation or arbitration before resorting to court action.
13. Amendments to Terms
